Archer Aviation cleared FAA Phase 3, becoming the first eVTOL developer to do so, putting US electric air taxi service on track for 2026
21 May 2026

Archer Aviation has crossed a regulatory threshold no electric air taxi developer had reached before. In April, the company closed Phase 3 of the FAA's four-phase type certification process for its Midnight aircraft, the first in the sector to do so, establishing what analysts described as a credible timeline for commercial electric flight in American cities.
Phase 3 completion means Archer and the FAA have agreed on the full certification basis, the means of compliance, and the test plans that will govern Phase 4. That final stage requires physical proof: FAA-witnessed testing confirming that the aircraft as built meets every applicable airworthiness standard. Each compliance item resolved in Phase 3 becomes a foundation for what follows, not an obstacle within it.
Through the White House's eVTOL Integration Pilot Program, spanning eight states including Texas, Florida, and New York, Archer may begin piloted city flights before full certification is granted. Serving as the designated air taxi provider for the 2028 Los Angeles Olympics gives the company a fixed commercial deadline against which its Phase 4 timeline now runs.
Financially, the company entered the second quarter with $1.8 billion in liquidity. First-quarter 2026 revenue reached $1.6 million, reflecting initial activity at Hawthorne Airport in Los Angeles and marking the first operational receipts in Archer's history. The quarterly net loss of $217.7 million remained consistent with pre-commercial investment levels. Transition flights from vertical to forward flight are scheduled for the second half of 2026.
No electric air taxi developer has set a benchmark this concrete before. Archer's Phase 3 closure gives every competitor a fixed point of measure, and the results could shape regulatory timelines for electric aviation across the industry in the years ahead.
